New Reemployment of UC Retired Employees Policy Guidelines & FAQs

As announced in the March 6 issue of HR Update, a new policy has been issued that governs the reemployment of all former UC employees who are rehired into SMG or staff positions.

  • Those retirees who received a lump sum cashout prior to January 1, 2009 but were not reemployed as of December 31, 2008 may be appointed to a career position during 2009 and be grandfathered under the new policy until their appointment ends or until there is a change in their current appointment, whichever occurs first.
  • Those retirees who receive a lump sum cashout January 1, 2009 or later are subject to the provisions of the new policy and may not be reemployed in a career position. During 2009, the University will inform all past lump sum cashout retirees about the changes in rehired retiree requirements
  • Rehired retirees who were employed on or before December 31, 2008 will be grandfathered under the new policy until they reach their appointment end date or until there is a change to their current appointment (e.g., change in percentage of time, extension of appointment, new appointment, etc.) whichever occurs first. Until that time, they will be subject to the “Guidelines for Rehire of UC Retirees” that governed the rehire of retirees prior to the implementation of the new policy.
  • Retirees who were employed on or before December 31, 2008 who have appointments with an indefinite end date or an appointment with an ending date for budgetary purposes only (e.g., career appointment but extramural or soft funding): will be grandfathered under the new policy until their appointment ends or until there is a change to their current appointment (e.g., change in appointment type, reclassification, etc.) A systemwide review process is underway for all indefinite appointments. This will determine whether a sunset date can be established and the operational impact in doing so. Until that time, such individuals will be subject to the “Guidelines for Rehire of UC Retirees” that governed the reemployment of retirees prior to implementation of the new policy.
  • A new process for requesting to rehire a retiree has been implemented and will require departments to submit the Rehire Approval Form along with the UCRP Rehired Employee Election Form to Rene Jackson, HR Director, at rene.jackson@ucop.edu. The request will then be triaged to the President's office for review. Departments may not rehire a retired employee until an approval is granted.
  • Please note: this new policy does not apply to retired faculty hired into academic positions though does apply if faculty member is rehired into staff or SMG positions.
